Geosyntec Staff to Present at 2017 Air & Waste Management Association Annual Conference & Exhibition

Jim Culp, Ron Arcuri, Kate Graf (Pennsylvania), Bill Gaffigan (Georgia), Lisa Goode (Oregon), and Joe Cleary (New Jersey) will all be presenting at the 2017 Air & Waste Management Association's (A&WMA) Annual Conference & Exhibition (ACE) at the David L. Lawrence Convention Center, in Pittsburgh, Pennsylvania on June 5–8, 2017.

The ACE, entitled "Bridging Environment, Energy & Health", will examine how leaders in industry, government, academia, and non-governmental citizen groups work together to improve community health and protect the environment.

Panel to discuss the issue of U.S. EPA's expansive assertions of authority, the misuse of science and the practice of sue and settle in the context of actions such as enhanced monitoring and fence line monitoring deployed through U.S. EPA's policy on Next Generation Enforcement. Discussion to evaluate authority in rulemaking, settlements, permits and information requests. Expansion of Agency use of information requests to "order" enhanced monitors/fence line monitoring raises the need to evaluate statutory authority, including the ability to directly enforce the NAAQS against individual facilities; the apparent sidestepping of due process, and discussion of the ethics of the U.S. EPA proceeding in such a fashion. The misuse of science to provide a false context for the Agency's public dissemination of data designed to inflame local communities is of particular concern.

Inclusion of new monitoring technologies in regulations and permits provide at least some due process challenge rights. In those instances, the primary question is the efficacy and validity of the monitor and its data with respect to the process and established limits. Inclusion of new monitoring technologies, installation
of which is "ordered" through an information request and subject to the heavy handed practice of sue and settle raises substantial questions of authority, validity, due process and the ethics of the Agency proceeding in this fashion. Session to include some projection on how these issues may play out in the current administration.
